EU court upholds denial of Nike’s SUPPORT-FIT trademark

On 23 October 2024, the General Court of the European Union (GCEU) affirmed the EUIPO’s Board of Appeal decision in Nike Innovate CV v. EUIPO (Case T-1072/23), ruling that Nike’s EU trademark application for SUPPORT-FIT lacked distinctiveness and was descriptive of the goods, except for headgear.

Madrid Protocol fees revised for San Marino

In accordance with the provisions of the Common Regulations under the Madrid Agreement and Protocol concerning the International Registration of Marks, the Director General of the World Intellectual Property Organization on 31 October 2024 announced the revised individual fees payable when Uzbekistan is designated in an international application or in an application for renewal of international registration or is a subject of subsequent designation.

Unregistered trademarks outside courts’ purview, rules Argentine court

On 16 September 2024, the Federal Court of Appeals in Civil and Commercial Matters of Argentina, in the Terrawind Reps SA de CV v. Maria del Pilar Lozano Mancipe case, affirmed a lower court’s decision, concluding that it lacked jurisdiction to hear the cancellation of several trademark applications filed by Terrawind Reps SA de CV.

WIPO releases 2025 version of 12th edition of Nice Classification

The 2025 version of the 12th edition of the International Classification of Goods and Services for the Purposes of the Registration of Marks (Nice Classification) released by the World Intellectual Property Organization (WIPO) will enter into force on 1 January 2025, and the International Bureau (IB) of the WIPO will start applying the new version to all applications for international registration received on or after that date.
